		<content:encoded><![CDATA[<P>NOTE: This is the first in a series of 5 articles:"Small Business Tax Traps and How To Avoid Them"If you're a sole proprietor, perhaps you've consideredincorporating your small business or self-employmentactivity.And so maybe you've been wondering,"When is the best time to incorporate?"From a legal standpoint, any time is the best time.The sooner you incorporate, the sooner you make the movefrom the world of unlimited liability to the world oflimited liability.From a tax savings standpoint, any time is the best time.The sooner you incorporate, the sooner you will startputting more money in your own pocket and less in Uncle Sam's.(For more about the potential tax savings of acorporation, see the second article in this series --"Tax Trap #2: Double Taxation -- Isn't Once Enough?"<a href="http://www.YouSaveOnTaxes.com/tax-trap-2.html">http://www.YouSaveOnTaxes.com/tax-trap-2.html</a>)But from a **tax reporting** standpoint, there is one timeof year that stands out as best: January 1st.Why is that?Assuming you have a sole proprietorship (or other entity,such as a partnership) that is up and running as of January 1, and assuming you then incorporate thatexisting entity on any date other than January 1,you face the possibility of filing not one buttwo business income tax returns for that year.Here's an example to clarify this important point . . .Let's say you've been operating your sole proprietorshipfor a few years, and in early 2005 you decide to incorporate. In January you get around to startingthe paperwork, but life gets in the way andyou finally get it done in late February. By the timeyour state processes the Articles of Incorporation,the start date of your new corporation is March 1.For 2005, you must file a Schedule C for the periodof January 1 through February 28, when your businesswas still a Sole Proprietorship. </P><P>And you must alsofile a corporate income tax return for March 1 throughDecember 31.Maybe that's no big deal. Maybe you enjoy filingone business income tax return so much, filinga second one doesn't bother you. And it may bethat the inconvenience of filing two tax returnsin 2005 is far outweighed by the legal and taxadvantages of incorporating.Keep in mind, too, that 2005 will be the only yearyou have to do this "double duty". In 2006 youwill only have to file the corporate income tax return.But if you are thinking about incorporating, thebest time to do it, from a tax paperwork standpoint,is as of January 1. Only then do you have a "clean break"from the old sole proprietorship to the newcorporation.This timing issue can also be relevant if youdecide to make the switch late in the year. </P><P>Ifthe effective date of the incorporation is November 15,you will have to file a Schedule C for January 1through November 14, and a corporate return forNovember 15 through December 31. In that scenario,you should ask yourself, "Do the benefits ofincorporating outweigh the convenience of waitinguntil January 1?"So before you decide when to incorporate, take a momentto reflect on the tax reporting consequences of incorporating on January 1 vs. any other date.Sometimes it may make sense to wait a few weeks(as in the second example), and sometimes it makes senseto "do it now", especially when January 1 is nearby.. </P>]]></content:encoded>

		<content:encoded><![CDATA[<P>Most "create-your-own-ebook" advice tells us to write about something we know or are interested in. That's a good place to start, but it isn't absolutely necessary. And if you follow the advice of successful Internet marketers ? "find the market first, then develop your product" ? it might not even be possible. For example, what if your market research tells you that an ebook about teaching ferrets to do tricks would be profitable, but you've never seen a ferret in your life? The answer? Research. And part of that research can include interviews. </P><P>If your initial research turns up the name of a noted ferret expert, for instance, an easy way to incorporate that person's expertise and knowledge into your ebook is to interview him. Here's a step-by-step process for conducting effective interviews:1. Decide WHO to interview. Make sure the person truly is an expert in the field and knows what he's talking about. Contact him (preferably by phone) to see if he's willing to do an interview. </P><P>Let him know you'll provide the questions in advance. Negotiate a deal that he's agreeable with. Some will do interviews for free as long as you mention their name in your ebook. Some will expect to be paid a fee. Some will be want rights to sell the ebook you create. </P><P>If you are unwilling or unable to provide what the expert wants, find another expert. 2. Determine the FOCUS of the interview. In our example, we're interested in writing an ebook about teaching ferrets to do tricks, so we don't care about their mating habits or the quality of their fur. 3. </P><P>Once your focus is clearly defined, create your list of interview QUESTIONS. Keep your target audience in mind? what do THEY need to know? What answers are needed in your ebook to provide the readers with the information they're looking for? In our example, our readers would probably want to know the best motivator for ferrets? is it food, petting, play, verbal praise? Put yourself in your readers' shoes: if YOU wanted to know how to teach a ferret tricks, what questions would you ask of a ferret expert?4. Determine the best METHOD for the interview. Interviews can be done in person, on the phone, or even via email. All are effective. </P><P>Use the method your expert prefers. 5. SCHEDULE the interview. Make the time (and possibly the place, if doing this in person) convenient to your expert. 6. </P><P>SEND your questions to your expert in advance of the actual interview. (Of course if the "interview" is being done via email, this isn't necessary.) But be sure to let them know that other questions may arise during the interview. This allows you to gain two types of information from your interview: the prepared, carefully thought-out answers you need, AND the spontaneous, off-the-cuff remarks that will spice up your copy. If your expert balks at the idea of unknown questions, assure him that he will have final approval on his comments that are included in your ebook. Spontaneous questions are also possible with email interviews. </P><P>Once you receive back the answers to the questions, read them over and think of a follow-up question or two? then CALL the expert and ask for clarification. NOTE: If doing interviews via email, always give them a deadline to reply back to you.7. RECORD your interviews -- even if you take excellent notes!. There's no substitute for being able to replay the comments as many times as needed to get an accurate transcription of what was said. Minicassette recorders are cheap, small and easy to carry around. </P><P>If doing a telephone interview, there are inexpensive devices that connect the recorder to your phone. NOTE: Some states do not allow recording of telephone conversations without the knowledge and permission of those being recorded. Some people do not feel comfortable having their conversations recorded. Whether doing the interview by telephone or in person, it's always best to ask permission to record it. Just tell them it helps you to get their comments as accurately as possible because your note-taking skills are lacking. </P><P>Also tell them that they will have final approval of their comments used in your ebook. This will ease their reluctance to have the interview recorded.8. TAKE NOTES of the interview -- even if you're recording it! Never totally rely on a recorder? the batteries can die, the tape can wear out or end without auto-reversing, the telephone connector might be hooked up wrong, etc. Always get as much down manually as possible to back up your recording.9. TRANSCRIBE your interview as soon as possible. </P><P>(Again, email interviews do not apply). This is particularly critical if your recorder failed and you're relying on your hastily scribbled notes ? and your memory to decipher them!10. INCORPORATE THE EXPERT'S COMMENTS into your ebook. This does not have to be done in the typical interview Q&A format, but that is easiest. How you incorporate the comments depends on the writing style of your ebook. </P><P>(This article doesn't go into that.)11. PROVIDE THE FIRST DRAFT of your ebook to your expert and ask him to verify the accuracy of the information attributed to him. This is important. The last thing you want to do is misquote him or get some of the facts mixed up. Plus he may even provide additional useful information as he reviews your ebook. </P><P>Another added bonus? by getting his approval, you're gaining his trust. If you wish to do follow-up ebooks in the future on the same general topic, it'll be easy to get this expert to assist you again.12. MODIFY the draft to incorporate the expert's comments. 13. FINALIZE and sell your ebook! (This is the really fun part!)14. </P><P>FULFILL YOUR AGREEMENT with the expert. Has he been paid? Did he receive his copy of the ebook? Even if he did the interview for free and asked for nothing in return, send him a free copy of the ebook along with a nice thank-you note.See? You don't have to be an expert or write only about what you know. Virtually anyone can write about anything with the right tools. You can actually view the animation at <a href="http://www.tongcom.co.kr/dingani_13.htm" target=new>http://www.tongcom.co.kr/dingani_13.htm</a>. It was definitely enjoyable and entertaining! The animator used the song "Last Christmas" by Beatles as the background for the animated Christmas music video.I must say that the one who made this animation has already mastered the Flash software. For your information, Flash is a powerful software program that can be used to create animated movies that are small in file size, load quickly, and incorporate user interaction and sound. Apparently, it may appear to be a relatively simple program because of its few tools compared to other software programs. </P><P>However, a world of complex authoring structures, advanced techniques, and sophisticated effects begins to unfold as one learns more about Flash.Regarding the creator of this animation, he certainly has a good combination of images, graphics and sounds in this masterpiece. He must have used his creativity and imagination meticulously in this animation. I was really impressed with the way it was created. It's very fascinating.With what I've seen, I'm looking forward to see your other creations, too. I hardly find experts in this software application and whenever I do, I'm always impressed with their works of art. </P><P>You'll get two thumbs up from me.To the creator of this Christmas animation, I only have three words for you. It was a HORRIBLE experience that actually turned out for the better. Let me tell you my story:I have a team of about 2000 associates. Since all my sites are hosted at Host4Profit except for the site that their websites are hosted on, I decided to transfer everything over. </P><P>Well, I have transferred many sites before so I knew how it worked. I knew I would get access to Host4Profit before transferring with my registrar and that all I had to do was upload everything over to the new host while my old host was still active. This would make a seamless transfer. No one would ever know anything happened ...To make a long story short, it didn't turn out to be as seamless as I hoped and things were a little messed up for about a day. Needless to say, I received TONS of emails!"What happened?!""Where did you go?!""Give me my money back!""Hello? Are you there?"Well, I couldn't ANSWER these emails because I was busy getting the transfer problem fixed. </P><P>This caused most of them to email me a SECOND time, therefore doubling the amount of emails sitting in my email box! Stress was building as I worked to get the problem fixed ....After the problem was finally resolved, I sent an update letting everyone know what happened. I got back to any emails that I felt needed answering ... this whole thing took almost 18 hours of my time and NO SLEEP for me!The stress and the fact that I had no sleep took it's toll on me. When I got some really rude emails from some angry customers and associates, I didn't take my own advice and let it sit until I calmed down. You know what I did instead? I gave refunds to all of them! I didn't even want to deal with it ... </P><P>as a result, I refunded over $1000 in sales.I know, I know ... you're asking yourself, "How could that be a good thing?" Well, it made me get out of my bull stubborn "I'll handle it all" attitude and incorporate some much needed help. Now I have someone to answer those emails, someone to answer those calls, and various other things. What a RELIEF! Why didn't I do it sooner?!  :)If you answered "Yes" to my first question above, heed my advice. If it happens to you, you can guarantee it also happens to your customers when they read your sales copy. So, what's the answer? You don't have to practise mind-reading, just good-old fashioned common sense - here's a four-step format to help you reassure your customers by answering those unasked questions: 1. "What's in it for me?" Paint a picture You already know it's important to promote the major benefits of using your product in your opening copy, but don't just list the benefits. Paint a picture so your readers can visualise themselves enjoying these benefits. </P><P>Not: "Save time and money with Acme widgets," but, "Free! Four hours a week to read a book, walk along the beach and follow your dream when you use Acme widgets the quickest Widget on the market today." 2. "How can you give me this?" Explain why People aren't silly, they're not going to believe something just because you say it's true. You must offer credible, logical reasons to support your claims. "Acme widgets achieve faster results because we incorporate not one, but two gizmos. In controlled tests conducted by XYZ, our widgets consistently out-performed the competition in speed, accuracy and endurance." 3. </P><P>"Why should I believe you?" Give reassurance. This is the time to give some details about you and your Company, provide information about your credentials, qualifications and experience in the field. Now you can also include brief testimonials from satisfied customers (provide as much information to identify the customers as they're willing to allow anonymous testimonials are almost worthless).  4. "What if I don't like it?" Eliminate the risk. </P><P>The final stumbling block is usually the fear of losing their money if they don't like the product or find its not what they expected, so offer your customers an iron-clad guarantee.  It can be a full refund, a double /triple money back or whatever you feel you can afford. Always include a time factor - the longer the better - people like to know you'll be around for the long-haul. Incorporate these answers in your sales copy to help turn your readers into buyers. In the UnitedStates you'll pay Federal and States taxes on your pretax profit. Thismeans that a California business pays 41% in taxes. You make money when you save on taxes. I'm not an attorney nor an accountant. </P><P>I'd advise that you discuss taxstrategies with your tax advisers. I'm offering the following from mybusiness experience. I work on the premise that you must pay taxes in thejurisdiction in which you earned the money. If you have a local business, don't incorporate in a tax haven state, likeNevada. The taxing state will still want their taxes on the money youearned. </P><P>Too many local businesses incorporate in such a way that the corporationpays taxes on the business income and the owners pay taxes on the proceedsfrom the corporation. If your corporate pretax profit was $100 inCalifornia, after taxes your company has $59.00. If you pay the $59.00 tothe owners, they must pay taxes and the after tax profit is $34.81. Toavoid paying 65% taxes, the owners should never have incorporated. Theyshould have asked their tax adviser about forming a LLC. </P><P>If you have a national business, incorporation in a tax haven State maymake sense. Compared to California, you'll save 8% on your company's income taxes. If the State tax savings justify tax haven incorporation, do it. If you have an international company, incorporation in a tax haven makessense. It won't save your company taxes on your U. </P><P>S. or Canadian businessincome. It will save you 40%-60% on your non-North American businessincome. This strategy is being used by almost every multinationalcorporation in the World. Those visions could be costing you a ton!Let me take a few minutes to explain what you need to know about incorporating your business. While it certainly isn't a move every business will want to make, there are definitely some large benefits associated with incorporation.MYTHIncorporating means I can't take money whenever I want it.TRUTHYes you can! This is a MYTH that holds a lot of small business owners back from incorporating. </P><P>If you set a payroll amount for yourself, then decide you want/need more money, you simply write yourself another check and call it an "owner distribution" or a "draw."MYTHThere's too much paperwork involved once you incorporate. I don't have the time.TRUTHThere are some additional forms you have to complete. There are some additional taxes you have to pay. HOWEVER... read this carefully... </P><P>for the three or four extra forms and the cost of the additional taxes, most businesses will still save when compared to counting every dollar you make toward personal income.MYTHThe only good reason to incorporate is for personal protection. The difference in taxes isn't that much.TRUTHWhile incorporating your business will help protect you from lawsuits and from having your personal property seized, there are more benefits than that.
